Why don't the police issue fines for illegal parking in private spaces?
The Highway Code applies only to public roads. The police cannot intervene in private spaces, except in cases of specific provisions (e.g., police orders).

Is it legal to issue a private fine?

I received a "fine" from Place Privée?
This is not legally a fine but rather compensation for occupying a private space or one reserved for a specific use (such as: "reserved for customers" of a business). The compensation requested is legal and you must pay it within 10 days. In the event of non-payment, a fee for searching your identity and a reminder of CHF 30.- will be applied. After this reminder, we will prepare a prosecution file in agreement with the beneficiary, which will generate new costs of CHF 150.-.
Legal basis regarding parking on a private parking space
Parking on a private space is governed by property rights (real rights), which also apply to tenants.
Unauthorized occupation of a parking spot by someone who is not entitled (whether you are the owner or tenant) may be considered a trespass.
According to Art. 928 of the Swiss Civil Code (CC), the disturbed possessor may take action against the person causing the disturbance, even if the latter claims a right to the object (para. 1).
The action aims to stop the disturbance, prevent it from recurring, and seek compensation for any damages (para. 2).
Disturbance of possession:
Any action by a third party that hinders or prevents rightful users from accessing their parking space creates damage.
Damage assessment:
The damage can be evaluated based on the duration, repetition, and direct impact on the possessor. Place Privée, based on existing case law and in the absence of detailed proof of the loss, suggests compensation between CHF 40 and CHF 60. In cases of repeated offenses or specific additional harm, a higher amount may be claimed.
Possessory action:
Article 928 CC allows the possessor to take legal action or act directly.
